Digital Marketing Increase Guarantee

6.1 Guarantee Period

Where a Digital Marketing Guarantee has been offered and agreed as part of this Agreement, the guarantee period shall commence from the start of Month 2 of the engagement, not Month 1.

6.2 Setup & Learning Month

Month 1 of the engagement is designated as a setup and onboarding period. During this time, the Agency will:

  • Have been granted full access to required platforms, accounts and assets
  • Develop strategy, creative assets, ad copy and campaign structures
  • Configure tracking, analytics and reporting
  • Allow reasonable time for platform algorithms to enter a learning phase

Performance during Month 1 is not representative of ongoing campaign output and is therefore excluded from any guarantee assessment.

6.3 Guarantee Assessment Window

The guarantee will be assessed across Months 2, 3 and 4 of the engagement (the “Guarantee Period”). Performance benchmarks, targets and measurement criteria applicable to the guarantee will be evaluated against results achieved within this window.

6.4 Conditions Precedent

The guarantee remains conditional on the Client meeting their obligations under Clauses 3 and 4 of this Agreement throughout the Guarantee Period, including (but not limited to) timely provision of access, assets, approvals and prompt responses to communications. Failure to meet these obligations may void or suspend the guarantee at the Agency’s reasonable discretion.

6.5 Eligibility

This guarantee applies only to Arise’s digital marketing services, such as social media management, SEO, PPC, and email marketing. Website design, development, or support services are not included.

6.6 Performance Metrics

We guarantee an increase in at least one of the following metrics: exposure, traffic, or conversions within the Guarantee Period as defined in Clause 6.3.

6.7 Baseline Measurement

The increase will be based on metrics either from the months immediately before our engagement or from the same seasonal period in your last normal year of trading, provided that data meeting the criteria set out in Clause 6.12 is available.

6.8 Minimum Increase

Fulfilling the guarantee requires an increase in only one of the specified metrics (exposure, traffic, or rankings).

6.9 Commitment Period

Clients must complete a full engagement through the end of the Guarantee Period (Months 2–4) to be eligible for this guarantee.

6.10 Our Commitment

Even without the guarantee or where it is considered invalid, we want to make it clear that we will make all reasonable efforts to excel in the services we provide for you.

6.11 Refund Policy

If we fail to increase any of the specified metrics within the Guarantee Period, we will refund 100% of our digital marketing service fees for that period. This refund does not include any third-party fees such as ad spend or subscriptions.

6.12 Data Availability

The guarantee is valid only if the client can provide historical data meeting all of the following criteria:

  • Data must cover a minimum of the last 12 months, or an equivalent seasonal period from the last normal year of trading
  • Data must be sourced directly from a recognised platform (e.g. Google Analytics, Google Search Console, Meta Business Suite, or equivalent)
  • Data must be accessible to the Agency via platform access or verified export, not self-reported figures
  • Data must show no significant gaps, anomalies, or unexplained interruptions that would undermine baseline comparison

If data does not meet these criteria, the guarantee will not apply. The Agency will confirm in writing whether the guarantee applies upon receipt of a valid claim. This determination is final.

6.13 Client Engagement

Where the Client fails to respond to communications, provide requested materials, or fulfil their obligations under Clause 3 within a reasonable timeframe during the Guarantee Period, the Agency reserves the right to void the guarantee by written notice.

6.14 External Circumstances

The guarantee is void in cases of unforeseen external circumstances beyond our control, such as economic downturns, pandemics, or other extraordinary events.

6.15 Late Payment & Business Closure

If a client fails to pay any invoice within the payment terms set out in Clause 2.1, or goes out of business within the Guarantee Period, the guarantee is void.

6.16 Claim Process

Clients must submit their claim within 15 days following the end of the Guarantee Period to be eligible for a refund. Failure to do so will void the guarantee.

6.17 Time Limitation

The guarantee is only valid for the initial Guarantee Period as defined in Clause 6.3 and will not be renewed or extended.

6.18 Verification

Arise reserves the right to verify all data and claims submitted by the client before issuing a refund.

6.19 Amendments

We reserve the right to amend these terms at any time, and clients will be informed of such changes in writing.
